Letitia James Beat Musk With Six Words Elon Musk’s X hired Floyd Abrams, the lawyer who beat Nixon for The New York Times. The social media giant didn’t want to tell New York how it handles hate speech. X lost anyway, to a judge Trump put on the bench himself. New York requires any platform earning over $100 million a year to file a report twice a year, laying out its rules on hate speech and harassment, how it plans to enforce those rules, and how many posts it flagged and acted on. Nobody can make X delete a thing. It only has to say what it does. State Senator Brad Hoylman-Sigal and Assemblymember Grace Lee wrote the law with the Anti-Defamation League. Gov. Kathy Hochul signed it in December 2024. Shortly after buying the company, Musk dissolved Twitter’s Trust and Safety Council—and in June 2025, he sued the state of New York over the law. Attorney General Letitia James defended it, and the judge in the case, John Cronan, sided with her on Wednesday. Six words were clearly laid out in the ruling: “The First Amendment poses no obstacle.” Cronan dismissed the case with prejudice, so X can’t refile it. These reports don’t just sit and gather dust in a filing cabinet. New York makes them publicly available in a database that anyone can search. X’s report is due October 1. Musk’s X spent 14 months fighting so it wouldn’t have to file that report. They lost. The Watchdog Now Coming For  Pirro’s License On Tuesday, a legal watchdog asked regulators in two states to investigate whether US Attorney for DC Jeanine Pirro should keep her law license. In New York, the courts run a committee that investigates lawyers and can suspend or strip a license. The Legal Accountability Center filed there against Pirro and one of her prosecutors, and with Virginia’s bar against the other. Pirro tried to indict Senators Mark Kelly and Elissa Slotkin and four House Democrats—five veterans and one former intelligence officer—for making a video telling troops they can refuse illegal orders. In February, a grand jury heard the case. Prosecutors needed twelve votes to indict, and they got none. The filing calls her push a “patently improper effort” with no legal basis. Says Pirro “knew or should have known” there was no case, because the video was protected by the First Amendment. They added that the only reason for the case was to punish and frighten Trump’s enemies. The group also filed against Ed Martin Jr., who ran that office before her. They’re going through it one prosecutor at a time. Pirro’s job ends when Trump’s does. The license was supposed to be the part that lasted. The Email That Should Have Sunk  His Nomination In 2019, the second-highest-ranking American diplomat in Samoa warned his ambassador that Kennedy was coming to town, and why. “The real reason Kennedy is coming is to raise awareness about vaccinations,” Tony Greubel wrote. Greubel had also discovered that an embassy staffer had been helping arrange the visit in a personal capacity, and ordered him to stop. Kennedy arrived in a country where vaccination rates had collapsed after two infants died from an improperly mixed dose. He met with local anti-vaccine activists while he was there. Months later, measles tore through the islands and dozens died. Six years later, he sat before the Senate and said the trip had nothing to do with vaccines. Sen. Ed Markey asked at least three times—Kennedy denied it every time. The Senate confirmed him 52 to 48. The embassy emails were tucked away in a government file the entire time. AP reporter Michelle Smith submitted a request for the State Department’s records on the trip in September 2023—more than a year before Kennedy’s nomination. The department found more than a thousand pages, then stalled and told her to expect an answer in February of 2026, a year after Kennedy was sworn in. So AP sued, and the records came out anyway. They include Kennedy’s own January 2019 letter to Samoa’s prime minister—the one that uses “vaccine” or “vaccination” eight times. Sen. Ron Wyden is now pushing GOP colleagues to refer Kennedy to the DOJ for a criminal investigation. Wyden says “There are consequences for lying to Congress.” HHS calls any claim that Kennedy lied defamatory. Right now, Wyden is in the minority. He can’t subpoena or compel a criminal referral. And Republicans clearly would never hand him one. But if Democrats take the Senate, Wyden would chair the Finance Committee—and he’s made clear what he would do with that. November is coming. A Judge Just Blocked Trump’s Ballot  Rule Some states mail their first ballots next week. On Thursday night a federal judge made sure they get sent out the normal way. Under Trump’s rule, the Postal Service had to approve each state’s envelope design first. Until that approval came, election officials couldn’t upload their voters’ names and addresses into a brand-new federal system. Miss any of it and the Postal Service wouldn’t deliver the ballots at all. Judge Indira Talwani stopped the heart of that rule everywhere in the country for the next fourteen days. States have “neither time nor funds” to rebuild their election systems two months before an election, she wrote. Election officials told the court it couldn’t be done in the time left. The government never responded. Then the judge lined up three things the DOJ had told her. This month: a court could block the rule fast if it ever hurt a voter. Last week: the states could just go file a new complaint. This week: the states waited too long. They spent two weeks telling her the states had a remedy, then argued the states had missed it. The judge also pointed out that after months of this fight, nobody has put a single piece of evidence of mail ballot fraud in front of her. Not one. Talwani decides on a longer block after September 3, and the regime is expected to appeal. But as of now, nobody’s ballot gets turned back next week. No one said this fight would be easy, and we always knew Trump and his accomplices would do anything they could to interfere in the election. That’s why we need to turn out to the polls in record numbers in the midterms—so many voters that the results are indisputable. Turning Trump into a lame duck means putting a freeze on his harmful legislation. Getting the ball rolling on accountability for their brazen acts of corruption and violence. I'm a judge of elections in a purple twp in NE PA. PA state law mandates that when in doubt, a prospective voter has the right to file a Provisional Ballot in person on election day. I believe most states have this provision. It's my job to personally handle this when issues arise, usually due to a late mail in ballot. There is a prescribed process which must be signed off by myself and the "minority inspector" on our election team ( a registered voter of the opposite party of my position. These are hand checked by a team at the county election office and reviewed by the elected County Commissioners before being lowed to count as a legal vote. So the the process is triple checked! To cut down on the confusion, we need to encourage everyone we know to VOTE! 30% of the registered voters did not vote in 2024.
