At yesterday's Senate Judiciary Committee hearing, Senator Mike Lee told former special counsel Jack Smith that his handling of lawmakers' phone records arguably makes Watergate look like a Sunday picnic. There's a detail Lee didn't mention. On January 6, 2021, while a mob was forcing its way into the Capitol, Donald Trump called Lee's personal cell phone by mistake, looking for Tommy Tuberville so he could press him to delay the count. That is exactly the kind of call Smith's toll-record subpoenas were built to trace. In this video, we break down what Smith's team actually collected and why. The records show who called whom and for how long, but nothing about what was said, and for the senators whose records came out first, they covered just four days around January 6. We also look at the real flaw in the process, including gag orders that were issued without telling the judge the phones belonged to members of Congress. And we look at why that flaw didn't start with Smith: Trump's own Justice Department secretly went after the records of Democratic lawmakers, their aides, and family members, including a minor. Finally, we look at what happens next. Todd Blanche, one of Trump's former defense lawyers and now the attorney general, is weighing a referral that could lead to charges against the prosecutor who indicted his old client. Meanwhile, the bipartisan bill that would limit these secret gag orders for everyone has sat in the Senate Judiciary Committee since January without a vote. Call the Capitol switchboard and ask your senators why. Tell us in the comments whether senators should be told when their records are pulled if the rest of us aren't, and subscribe so you don't miss what comes next. #JackSmith #MikeLee #Watergate #January6 #SenateJudiciary #TrumpDOJ #NDOFairnessAct #Privacy #Democracy #PoliticalNews
