We’re in the final eight days of this together, and your first briefing is at the bottom of today’s edition: where the Senate and House races moved overnight and who’s already voting. I’ll have one for you every morning until the polls close. One more thing from the New Mexico lawsuit that didn’t fit in the section: it says Epstein lent his lawyer, Darren Indyke, $7 million that was never paid back, helped him buy two homes, and paid for rounds of IVF. If someone you love should be reading this kind of reporting, a gift subscription gets them in, and founding members keep this whole operation running. Want to do a little more? My Venmo is https://venmo.com/u/dworkinreport https://youtu.be/-QpBFD6uh8U?si=OYHPpeWLgf6QyNOH Trump Fought To Hide His Plan For Election Day. He Lost. Also inside: his own judge turns on him, the Trump ally Brazil just rejected, and the state holding Epstein’s money men accountableThanks so much for joining me today, I have some great news to share with you. Starting with the fact that, as of Sunday, more than 27 million Americans had already voted. In states that track party registration, registered Democrats cast 46% of those ballots, and registered Republicans just 31%. Momentum is on our side, and I want everyone to know that. So before you scroll down, be sure to hit the ❤️ like button and restack—that shares this edition with everyone who follows you on Substack. Trump’s lawyers have to turn over his Election Day plans today, and I want as many people as possible watching. With only eight days left until the election, our reporting and organizing efforts are both going full throttle. And right now we need all hands on deck to make sure we can finish strong. Starting today, paid subscribers get my briefing every morning until the polls close. Help fuel our independent reporting and relentless organizing through Election Day—and beyond—by joining us as a paid subscriber here: The Prosecutor Going AfterEpstein’s Money MenOn October 21, New Mexico’s Attorney General Raúl Torrez sued Darren Indyke and Richard Kahn—Jeffrey Epstein’s longtime lawyer and accountant who run Epstein’s estate. Epstein’s trust had set aside $50 million for Indyke and $25 million for Kahn. I reviewed the entire lawsuit. It states Indyke kept asking Deutsche Bank how to take cash out of Epstein’s accounts without setting off an alert with the government. It says that from 2013 to 2017, he made 97 cash withdrawals, for around $200,000 a year. Each one was under the $10,000 mark banks have to report on. The complaint alleges that in 2018, he took out $100,000, claimed it was for “tipping and household expenses,” and used it to pay women in Epstein’s trafficking ring. In the court documents, the state quotes a 2017 email that Kahn sent to Epstein about paying “the latest batch of medical expenses for girls.” Torrez wants a judge to freeze all payouts so the money can’t disappear while the case plays out. “Those resources rightfully belong in the hands of survivors,” he said. Survivor Anouska De Georgiou stood next to Torrez at the announcement of the lawsuit, and said: “We cannot undo what happened or return what was taken from us, but we can demand answers.” A lawyer for Epstein’s estate says the claims are categorically false. When New Mexico asked for the Epstein files, the Trump regime sent back only 31 pages. In July, Attorney General Todd Blanche told the Senate in writing that the DOJ won’t prosecute anyone else connected to Epstein. Every single person who helped Epstein should face justice. The DOJ won’t do it, but New Mexico isn’t afraid to go to court. Trump’s Own Judge Just Made TheRegime 0-27In February, the Justice Department sued Utah to get the private data of every voter in the state. That would include full birth dates, driver’s license numbers, and partial Social Security numbers. Utah already had handed over the public voter file, but refused to give up the rest. Then in September, the regime told GOP Lt. Gov. Deidre Henderson—the official who said no—that she was under investigation. On Friday, Trump-appointed US District Judge David Barlow threw the case out, dismissing it with prejudice, which means the regime can’t come back with the same suit. The regime argued a 1960 civil rights law requires Utah to hand over the data. That law covers records that come into an election official’s possession. Barlow ruled that a voter database built by a state isn’t one of them, and said the courts have “no warrant to elevate vague invocations of statutory purpose over the words Congress chose.” That’s 27 losses in a row in federal district court for the regime. Henderson posted just this on social media: “0-27.” Trump wanted millions of voters’ private info, but no judge in the country would give it to him. Not even one he picked himself. Utah’s voters keep what’s theirs. Brazil Just Told Trump’s Ally NoOn Sunday, Brazil re-elected its president Luiz Inácio Lula da Silva, who goes by “Lula.” After every ballot was counted, he beat Flávio Bolsonaro 51.8% to 48.2%. That’s a margin of nearly 4.4 million votes. Flávio is the son of Jair Bolsonaro—Brazil’s former president who was sentenced to 27 years in September 2025 for plotting a coup after he lost to Lula in 2022. As someone who also tried to steal an election, of course Trump went all in for the Bolsonaros. In July of 2025, he put a 50% tariff on everything Brazil sells to the US. Trump wrote a letter to Lula calling the case against Jair Bolsonaro a witch hunt. A few weeks after that, the US Treasury slapped sanctions on the judge running the case. Bolsonaro was convicted anyway. In May, Trump welcomed Flávio into the Oval Office. Flávio was promising the voters he’d pardon his father. Flávio led in the first round by more than 2 million votes. On Sunday, Brazil voted again, and Flávio took the early lead. Then, with about half the votes counted, Lula pulled ahead and never looked back. Luzia da Souza, who runs a bar in Rio de Janeiro, told AP, “Lula is a man of the people and he knows what it’s like to be poor.” Under Lula, the United Nations took Brazil off its Hunger Map last year, and this year workers earning up to about $900 a month stopped paying income tax. Flávio refused to concede and demanded results get thrown out—the same sore-loser stunt Trump pulled in 2020. Trump bullied an entire country to protect his friend, but Brazil made fools out of them both. It convicted the father, beat the son, and showed the world how to handle Trump’s tantrums. Lula starts his record-setting fourth term on January 5. The NAACP Is Making Trump ShowHis PlansIn February, Trump’s old adviser Steve Bannon said on his show that ICE would “surround the polls come November.” On September 18, the NAACP and eight other groups sued to stop it. On October 21, Judge Loren AliKhan ordered the regime to start turning over its election plans. By today, they are supposed to submit any records on sending FBI agents, ICE, and Border Patrol to polling places, ballot drop boxes, and election offices. They also have to hand over the orders behind the agents who have recently knocked on doors in nine states asking people about voting—the same operation a nurses’ union got blocked in court last week. The regime also has to provide any threat reports and rules for when agents can show up at the polls—by Wednesday. Trump’s lawyers fought it, arguing that the groups “do not point to any policy or statement that DHS intends to deploy armed federal agents to polling locations.” In that filing, they never denied there’s a plan. On October 29, the judge gets a report on what they turned over, and I’ll tell you exactly what’s in it. Trump wants people afraid to vote, but he’s going to lose that fight too. The Morning Briefing: Eight DaysOutWhere the Senate and House races moved, and who’s already voting. The Senate map tilts our way. Republicans hold 53 seats, so Democrats need a net gain of four to take the majority. As of Sunday, Decision Desk HQ’s forecast had Democrats winning 51 seats, with a 56% chance at the majority. Its four toss-ups are all Republican seats: Iowa, Maine, Ohio, and Texas. Inside Elections moved Texas to a Toss-up too. Republicans are defending red areas. Cook rates seven Senate races as toss-ups—Republicans hold six of them. Kansas is one. Kansans haven’t sent a Democrat to the Senate since 1932. Trump flew there himself on October 19 to prop up GOP Senator Roger Marshall. The House is ours to lose. On Friday, Cook moved 19 more House races our way. Democrats are now favored in 220 seats—two more than the 218 it takes to win the majority—while Republicans are only favored in 198. There are only 17 toss-ups. Cook predicts the likeliest outcome is a Democratic gain of 12 to 22 seats. Four Republican incumbents are slipping behind. GOP Reps. Juan Ciscomani in Arizona, Gabe Evans in Colorado, Jen Kiggans in Virginia, and Derrick Van Orden in Wisconsin all moved from Toss Up to Lean Democrat. And two open seats just got harder for them—Kentucky’s 6th and Texas’s 35th moved from Lean Republican to Toss Up. Early voters are showing up. By Sunday, more than 27 million Americans had voted. North Carolina was running more than 38% ahead of 2022 as of October 19, and registered Democrats there were voting at more than twice the rate of Republicans. In Harris County, Texas, about 1 in 5 registered voters cast a ballot in the first week of early voting, the fastest start to a midterm there since at least 1998. The Bottom Line: The forecasts moved our way last week, Democrats are favored to take the House and the Senate, and early voters are turning out big. But I’ve run enough campaigns to know this is when people get comfortable. Don’t. With only 8 days until Election Day, we work like we’re behind and sprint through the finish. We’re only eight days away from the election. After ten years of fighting Trump, there’s no way we’re taking our foot off the gas now. And our work doesn’t stop on November 3. If Democrats win, we’ll be the ones making sure they deliver on what they’ve promised. We aren’t electing them just to act like they are bipartisan, or to play Trump’s games. Whatever happens, we’ll be here every day, reporting on what corporate media won’t, organizing against the regime on social media, and running one of the largest pressure campaigns on Congress ever. A FEW OF MANY COMMENTS:
MASSACHUSETTS HAS 9 BALLOT QUESTIONS. (Stuff to study in your pajamas!):
This from MASSACHUSETTS WBUR TODAY:
Midterms memo: Voters have cast more than half a million ballots since early and mail-in voting began, according to data collected by election officials as of Friday. Election Day is Nov. 3, but if you want to cast your ballot sooner, early voting runs through this Friday. And if you're using a mail-in ballot, it must be postmarked by Election Day.
Still deciding how you'll vote? You can get caught up on all the ballot questions here (and watch this video for tips on keeping yourself organized).
INFORMATION:
As of October 26, 2026, 596,614 ballots have been cast in Massachusetts for the midterm election, which includes both mail-in and early in-person votes.
How does the number of ballots cast in Massachusetts compare to previous elections?
In the 2024 general election, 3,512,930 ballots were cast, which represents a turnout of 68.4% of eligible voters. This is an increase from the 2,511,461 ballots cast in the 2022 midterm election, where the turnout was 48.9%.

BRAVO NEW MEXICO!
The FBI told NEW MEXICO and NEW YORK to STEP DOWN" because they were handling...never did!
Now OBSTRUCTION! (There are reports that bodies are buried on the property, What if it's someone's child?)
HOWARD NUTLICK (sic) LIED about his relationship with EPSTEIN...even visited EPSTEIN'S ISLAND.
JPMORGAN CHASE exchanged emails about EPSTEIN'S 'business', may have participated, failed to report just as they did with BERNIE MADOFF.
LOBBBYIST JOHN SUNUNU denied going to DUBAI, denied knowing EPSTEIN (was included in EPSTEIN REPORT)...EPSTEIN supporters contributed to JOHN SUNUNU's campaign. WHY?
TOO MUCH EFFORT, ENERGY has been expended to continue the COVER-UP!
Information is BEING DENIED TO EUROPEAN ALLIES!
We are all SICK & TIRED of EPSTEIN due to thee COVER-UP!
Scott thanks for the letters to protect our Polls and to toss Justice Roberts. I encourage everyone to vote early as a way to avoid scare tactics by ICE and others. And Congress should absolutely question Roberts and his benefactors during his many years on the bench. Can't wait for Sheldon Whitehouse to do just that!!! :-)
Thank you! Getting those early votes banked is the best defense against any intimidation tactics. And Senator Whitehouse’s relentless focus on judicial accountability is exactly the leadership we need on the committee!
Sheldon Whitehouse is a Democrat who actually works. I’m more confident everyday of a big win on 11/3/26! Onward! There’s so much damage to fix & people to hold accountable. I’m ready for this phase; shut them up & arrest them before they steal anymore from us.
Accountability and repairing the damage are definitely the twin pillars of the next phase. We are right there with you!
As Ohioans, with husband having family in Michigan, we have contributed to Abdul El Sayid. Very impressed with him. We too are just recovering from flu…head cold, coughing, sneezing. Not fun . Thankfully we are much better. Wishing MI best of luck . Wishing all of us a blue tsunami!
Wishing you and your husband a swift and complete recovery from the flu! It is fantastic to see cross-state support for strong candidates like Abdul El-Sayed. We are all pushing for that blue tsunami!

Serbia, Hungary, Albania, hopefully Israel. Let’s fight for a better future, we’re so much better than this.
“… Hopefully Israel” … apparently over 100 K Israelis have emigrated.
Couldn’t stand the current govt run by extremists & self-preservationist, Netanyahoo.
It’s also unfortunate that due to this cabal the world disrespects Israel & antisemitism is on the rise around the world.
— international citizens must watch while crimes against humanity are ongoing, but they can’t DO anything about it.
** Israel is temporarily suspending its support of the West Bank settlers … don’t want voters to think they’re being too harsh!? 🙄
Israel just destroyed parts of Hebron because two Israeli soldiers were killed at a checkpoint. THOUSANDS of people have been evicted and lost their homes. https://www.theguardian.com/world/2026/oct/24/israel-soldiers-raze-west-bank-neighbourhood-hebron-families-from-homes :(
Ungodly and often under the auspices of their god-given territorial ‘rights’, when Palestinians have lived there as long as they or longer!
And ‘God help’ Israelis that refuse to be conscripted! 💥
— Barbarians under the Netanyahoo regime, just like under Trumputin!
"From your lips to God's ears!"
And let's not get complacent. Every vote is needed and counts.
And Scott, the best news you offer today is that less Republican's are voting. That
is the best news ever. Let's hope more of our Republican friends stay away from the polls, too.
Time for each and every single one of us to realize how important we are! Collectively, we are a force to be reckoned with! That's why "they" want to divide and conquer. Split us up, and they take over. We will NOT allow that to happen!!!!
As a long-time citizen of South Carolina, I'm accustomed to my vote not making a lot of difference.
But I also know that Trump wouldn't lie about winning the popular vote with a majority on a DAILY basis, unless every opposition vote really ate at his...skull stuffing material.
Even my little ol' vote
Love your little ol' vote foofaraw & Chiquita! - ARF back! :-)
Has anyone else noticed that Trump hasn't said, "The Blacks love me!" in quite a long while?
It's a long story, taking place over a 6.5 year timeline.
It began in 2020 when the GOP had no problem assuming that the announced BLM rallies would result in the burning of countless Black communities (a la Watts, and Rodney King.) The GOP ended up scared of the magnitude of their misjudgement, resulting in a 180 degree reversal for dealing with Term Two NO KINGS rallies. (Such as paying (in some manner) Nick Cannon and Amber Rose to thank Black citizens for staying home.)
Trump didn't learn about "true believers" with Iran. He learned that even in America there are those who cannot be bought; Black mothers of at-risk sons. (Which is basically every Black male youth in America. Frankly, about all we know of Trump's views on fatherhood, is that he wants to have sex with Ivanka.)
And Trump no longer lies about Black Americans loving him.
His attention span is the same as the life cycle of a fruit fly.
Actually Judy, I think the average fruit fly has the edge on him. :-)
True.
But the reason he no longer claims love from Black Americans is clearly fear of pushback.
And that's the only thing I can come up with that shows ANY sign of intelligence or awareness from Donnie Dangerous.
and he hops from one thing to another, throwing crap at the wall, see what sticks, move on to the next one, the next one, the next one...
Ha! Intelligence? Awareness? He can't even spell the words..''
and he hops from one thing to another, throwing crap at the wall, see what sticks, move on to the next one, the next one, the next one...
Ha! Intelligence? Awareness? He can't even spell the words..''
Exactly!
This decision to drop the phrase shows more discipline than almost anything Trump's ever done.
That's why it seems so important to put into the public sphere, and to have an understanding of why this specific pushback might terrify him so. (It never mattered before, and it seems to ONLY be Black voters he fears in this manner.)
The $75 million should be used to prosecute the lawyer and accountant.
Yeah, that’s not how that works. Should go to survivors.
